Unlike Criminal law, Civil law provides a process by which individuals or companies can sue one another for damages.  Damages are monetary (money) compensation for injuries, costs, and other loss associated with wrongful or “tortious” conduct.  A “tort” is a claim of action based in civil law.  Like there are “charges” in criminal court, civil court allows for claims based in “tort”  For example, if you are injured in an auto accident, the claim or lawsuit would likely be based on the tort of “negligence.”

Of course, it is not always necessary to file a lawsuit.  Generally, prior to filing a lawsuit, a skilled attorney will contact the potential defendant (tortfeasor) and demand an amount of money in order to settle the case.  If an amount is agreed upon, the parties will sign a “release” wherein the potential plaintiff (injured person) agrees to accept money and release the potential defendant from liability connected to the incident.

If an agreement cannot be reached, the attorney will consult with the client and consider filing a lawsuit.  Lawsuits are costly and time consuming.  However, most attorneys are compensated by contingency.  This means, that the injured does not pay the attorney “up front.”  Rather, the Attorney will only collect payment upon settlement or successful lawsuit.
